Course 11 outline - Making Immigration Work 2010

SRA CPD Introductory/Intermediate level (4.5 CPD hours)

ARE YOU 2010 CONTRACT READY? Have you got your head around Graduated Fees? Do you know what work you can claim under your Contract, and understand the pay rates and costs limits? Are you confident you understand and can apply the LSC Contract rules for immigration & asylum work?

This course has been ENTIRELY RE-WRITTEN to take into account the transition from Immigration & Asylum category work under the Unified Contract to that under the 2010 Standard Contract. It will provide advisers with the essential information they need to comply with and work effectively under an LSC contract.

By the end of this course you will be able to:

  • Understand and apply the Immigration & Asylum Category of Law Specific Provisions, whether the Unified or 2010 Standard Contract
  • Be familiar with the Graduated Fees Scheme, including boundaries between stages, additional payments, what work is paid at hourly rates, costs & disbursement limits, granting & refusing CLR
  • Know what work can (and cannot) be claimed for under the Contract and what constitutes a separate matter
  • Have a firm grasp of the key general provisions of both contracts, such as means assessment, scope and the sufficient benefit test, particularly as they relate to immigration & asylum work
  • Sleep easy, knowing that you have understood the key aspects of Immigration & Asylum contract compliance, giving you more time to meet targets

This course is essential for caseworkers new to carrying out Immigration work under an LSC contract, and would also be a useful refresher for more experienced advisers. It would also be useful for non-caseworkers working in a support role on Immigration contracts. The course will focus on Legal Help and Controlled Legal Representation (Licensed work will not be covered).
