Course 6 outline - Eligibility: Getting it right, proving it's right!

SRA CPD Introductory/Intermediate level (4.5 CPD hours)

Keep getting conflicting feedback about how to complete Legal Help forms? Worried you might have matters nil-assessed because the means assessment is wrong? Getting suitable evidence an ongoing battle? Angry at the apparent lack of leeway you have?

Fully RE-WRITTEN to take account of the changes under the 2010 Standard Contract, this course will give you a firm understanding of the principles of means assessment and eligibility. Means assessment continues to be the single largest reason organisations have matters nil-assessed by the LSC. It does not matter how good your casework is or how fantastic the results for your clients, drop your guard in means assessment and you will not get paid.

By the end of this course you will be able to:

  • Understand the contract rules and guidance on means assessment, including passporting, partners, allowances and disregards
  • Know how to deal with the the value of the client's home and any interest in other property
  • Understand and apply the ‘subject matter of dispute’ rules
  • Be clear on what evidence you need, when to get it and what do to if the client doesn't provide it
  • Know what to do if your client tells you their financial circumstances have changed
  • Be confident your files will demonstrate to the LSC that you are getting it right on eligibility

This course is vital for everyone involved in checking clients' eligibility, including non-casework staff and those who supervise them. It is essential for newer workers and will be a valuable refresher for more experienced staff looking ahead to the 2010 Contract. The course will cover eligibility for Legal Help and Help at Court, focusing on the rules relating to work in the Social Welfare Law & Immigration/Asylum categories.
