We know that many of you have been affected by the LSC's recent matter splitting exercise. This summer we are offering subject specific courses that take a fresh look at the matter splitting rules and ways of avoiding those dreaded nil assessments.

Now is also the time you need to familiarise yourself with the Category Specific rules so as to be fully prepared for the start of the new Contract in October – the Standard Contract is not exactly the same as the Unified Contract and you need to fully understand the differences. The subject specific courses will update you on all the key issues.

Making Housing Work 2010

The course will cover the effect that the forthcoming contract will have on Housing work, particularly any new or amended rules. For example, there are significant amendments regarding working with the Housing Court Duty Possession Scheme. The rules regarding separate matters in the 2010 contract will have a significant impact on Housing work. The new Contract and Specialist Quality Mark also include new rules specifically aimed at Housing supervisors.

Furthermore, the recent LSC multiple matters validation exercise found problems in the Housing category including the proper application of the current separate matters rules and applying the Sufficient Benefit Test at the outset. This course will help you to better justify any additional matters opened and hopefully avoid problems at audit.

Making Welfare Benefits Work 2010

The LSC multiple matters exercise found significant problems in the Welfare Benefits category regarding:

  • the proper application of the Sufficient Benefit Test
  • whether there is actually a legal issue at the outset
  • and whether the client could have dealt with it themselves

This course will discuss these issues in detail, including providing guidance on the changes to the ‘matter splitting’ rule, which is likely to have a significant impact on the Welfare Benefits category of law in particular. The course also factors in the new rules relating to Supervisors, including those within the amended Category Specific Provisions.
